Assistance
For workers who appeal on their own we offer various types of assistance to prepare for and go through the appeal process. It is your claim so you must be involved and comfortable with the approach and have the final say on the appeal.
In some cases, you might disagree with our assessment of your case. Sometimes we find the evidence available is not enough for us to make a reasonable argument. At other times, you might want to make a different argument from the one we recommend. In these instances, or where a worker chooses to handle their own appeal, the Worker Advisor Office will not be representing you, but can still assist by:
- Informing you about the appeal process
- Reviewing the file (if we have not already done so) to help clarify the issues related to the appeal
- Identifying and discussing the WCB policies that apply to your case
- Providing you with options on how to proceed
- Reviewing the appeal you prepare and will be submitting to the WCB
- Providing recommendations and suggestions on ways to make appeals stronger
Each worker’s case is different and may need different types of assistance from our office. We will try to help you in the way that best meets the needs of your case.
